Section 121 Mutiny of Prisoners


§ 121 has 1 earlier version and is quoted in 2 provisions


(1) Prisoners who band together and with united forces


1.
force or attack a prison officer, another public official or a person authorized to supervise, care for or investigate them (Section 240),

2.
break out violently or

3.
force one of them or another prisoner to break out,

are punished with imprisonment from three months to five years.

(2) The attempt is punishable.


(3) 1In particularly serious cases, the mutiny is punished with imprisonment from six months to ten years. 2A particularly serious case is usually present when the perpetrator or another party involved

carries a gun

2.
carries another weapon or other dangerous tool in order to use it in the act, or

3.
acts of violence put another in danger of death or serious damage to health.

(4) A prisoner within the meaning of paragraphs 1 to 3 is also anyone who is placed in preventive detention.
