Youth Protection Act 2021: Going out - but how long?

When children grow up to be teenagers, they also want to go out with their friends in the evening. But there is often a dispute about how long they can stay away.Basically, it's up to the parents. However, the Youth Protection Act regulates the stay in certain places.

When are children allowed to go to the cinema alone, and how long can they party in the disco or pub? Our table gives an overview:

Stay in discos and clubs

At public dance events, for example in discos, age and time restrictions apply. Children and young people under the age of 18 are not permitted to stay in night bars and clubs or in public amusement arcades. Young people under the age of 16 are only allowed to go to a disco if they have a parent or guardian. From 4 p.m. they can stay in a disco until midnight. This also applies if you are accompanied by an adult friend.

Exceptions in the Youth Protection Act

However, there are exceptions for events organized by a recognized youth welfare agency. These are, for example, youth meetings of parishes, associations or the church. Then children under 14 are allowed to be present until 10 p.m. The 14- and 15-year-olds end at midnight. The competent authority can also approve exceptions.

Concerts are excluded from these regulations because they do not count as dance events. Thus the time restrictions do not apply either. Sometimes, however, age restrictions are imposed by the competent authority or the organizer. In addition, young people always need their parents' permission.

Stays in restaurants

Children and young people under the age of 16 are only allowed to have a meal or a drink in a restaurant between 5 a.m. and 11 p.m. without being accompanied by a person with custody or legal guardian. Young people aged 16 and over are allowed to stay in restaurants unaccompanied between 5 a.m. and midnight. Accompanied by a person with custody or a parenting officer, children and young people are allowed to stay in restaurants for an unlimited period of time.

Organizers and business operators must comply with the Youth Protection Act

If the legal prohibitions of the Youth Protection Act are violated, these administrative offenses can be punished with a fine of up to 50,000 euros. The responsible authorities in the federal states can impose the appropriate sanctions to protect children and young people - in particular against traders and event organizers who do not observe the provisions of the Youth Protection Act.
